General Terms and Conditions for HAGAN SKI

Published and valid from 19 Febuary 2018.

These General Terms and Conditions only apply to purchases made and orders placed in this online shop. Our terms may be changed or adjusted. The latest version of these GTCs shall always apply. The date from which these GTCs apply shall always be specified above. Customers must first accept our terms of sale before they can place an order. By giving their acceptance, the customer is obligated to, and agrees to observe, these terms of sale.

Contract conclusion / option to correct

The customer's order represents an offer. A contract is concluded only upon acceptance on our part.

An order can only be placed if all of the mandatory fields marked with * in the order form have been filled out. The customer will receive an error message if entries are missing or if the order cannot be fulfilled for some other reason. The customer can make changes to their order before finally submitting it. The customer shall receive detailed information for support during the order process.

Once the order process has been completed, the customer shall be informed of this via an information window stating, “Your order has been completed and sent to us successfully”. By clicking the “Place binding order” button, the order process is completed, and we receive an offer to conclude a binding purchase agreement.

If we suspect improper use of our online shop during order placement or if an unusual number of items are included in the order, then we can reject the offer to conclude the purchase agreement. We do not need to provide a reason for this rejection.

As soon as we have received the order, the customer will be notified via the registered email address. However, this notification does not represent an acceptance of their order.

An order confirmation shall be sent to the address of the customer upon acceptance of the order. The customer is advised to carefully store this confirmation. It is regarded as proof of purchase. We shall not store the contents of the agreement. The contractual language is German.

Price and terms of payment

All prices are total prices. They include all taxes including VAT and levies but not shipping costs. You can refer to our shipping costs overview for information about these costs.

For deliveries to non-EEA countries, the consumer shall bear all import and export costs including any duties, fees, and levies.

The price calculated is that quoted at the time of order placement in the online shop and specified in the shopping cart. This price is also specified in the order confirmation. We reserve the right to adjust our prices without notification. Price changes are only valid for orders placed after these changes.

Despite the greatest care, some products on the website may not display the correct price. After receiving the order, the price will be checked by us. If the effective selling price is higher than the selling price indicated on the website, the buyer will be informed by us. The buyer then has the opportunity to receive the goods at the correct retail price or to cancel the order. If the effective selling price is lower than the price stated on the website, the lower amount will be charged.

We accept the following methods of payment/credit cards:

    • Credit card (VISA/Mastercard)
    • Paypal
    • Instant transfer (Sofort GmbH)
    • Advance payment/bank transfer

Prepayment/due date:

Unless another payment method is agreed, the customer commits to paying the full purchase price as soon as the contract is concluded. The goods shall not be dispatched until the payment has been received on our bank account.

If the goods are paid for via advance payment, a discount of 2% shall be deducted for payments made within three days.

If the purchaser does not even make a partial payment within the term of payment specified for a discount deduction, they shall not be entitled to any discount, not only for this partial payment, but also for all payments already made and any subsequent payments.

Right of revocation (right to withdraw)

You are entitled to withdraw from your purchase contract within 30 days without specifying a reason.

The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods;

the “Withdrawal Policy” page contains all necessary information about your right of revocation.

The consumer shall bear the return costs in the event of cancellation.

The right of revocation (right to withdraw) shall not apply to goods which have been made to customer specifications (touring ski set with mounted bindings) or which have been clearly adapted to personal requirements.


Statutory guarantee provisions shall apply. In the case of moveable goods, the guarantee period shall be two years from the date the goods are delivered.

Complaints based on statutory warranty claims or other complaints can be made using the contact details from the “Site Notice” section.


Unless agreed otherwise, we deliver within three to five working days after confirming the concluded contract.

For payments via advance payment/bank transfer, the term of delivery starts once the amount has been received on our bank account.

We shall indicate any differences in delivery terms on the respective product page.

We retain title of ownership to the goods until the purchase price has been paid in full.

Please check the goods for completeness after receipt. If the products are damaged or if the order is incomplete, please contact our Support Team. You have 14 days to check the products from the date on which you receive them.

Data usage / data processing

The customer agrees that the following personal data, specifically

  • name;
  • address;
  • date of birth;
  • will be processed for informational purposes and in order to personalise the web shop offers.

Use of cookies

To facilitate the purchase process and to enable contract processing by the web shop operator at a later stage, we would like to point out that user IP details are stored as cookie information, along with the name, address, and credit card number of the purchaser.

Data shall not be passed on to third parties unless Wirecard is used, in which case the customer’s credit card number is forwarded for the purpose of debiting the purchase price.

Data is processed pursuant to the statutory provision of § 96 (3) of the Telecommunications Act (TKG) and § 8 (3) (4) of the Data Protection Act (DSG).

Subscription to newsletter

If the customer agrees to receive our newsletter and has ticked the relevant box during the order process, then they agree to receive news about our company’s products, current offers, and other company-relevant information via promotional emails, in particular newsletters.


We carefully check that the information in our online shop is correct and take adequate steps to ensure this. Our liability is excluded for the contents of third parties. Furthermore, we assume no liability for the uninterrupted availability of our online shop.

Austrian law applies. UN Sales Law is expressly excluded.
